On Monday, January 25, 2022, the case was continued in the player's absence before Dundee Sheriff Court. The striker faced Kelty Hearts on that particular evening on behalf of his team. In the League Two match, he scored both goals as Elgin prevailed 2-0.

Hester is accused of organising a scheme with others prior to a 2019 cup match against Hibernian to make several bets on his getting a yellow card from referee Willie Collum. According to the charge, the striker intentionally stamped on a rival player in order to be given a yellow card.

On July 26, 2019, during the Scottish League Cup group stage match against Hibernian, Hester was given a yellow card. According to the accusation, Hester and three other people defrauded online bookmaker bet365 of £13,583 ($18,345).

Nearly a week prior to the game at Borough Briggs Stadium, the four are said to have made an agreement that Hester would "purposely commit a foul during the course of the match and receive a booking from the referee." They've refuted claims that they were "forming a fraudulent scheme to obtain money by placing bets that the referee would book Kane Hester during the match."

The trial has been postponed until later in the year. The court heard that while the Crown and defence agents might agree on some areas of evidence, the Crown's phone evidence would require expert analysis prior to the trial.

It is related to the case of Gavin Swankie, an Arbroath player, who was served with a notice of complaint earlier this month for nine alleged infractions of Scottish FA gambling laws.
